Federal Supreme Court Dismisses Three Kurdistan-Related Lawsuits

On Monday, 28 July 2025, the Federal Supreme Court dismissed three legal cases related to the Kurdistan Region, two of which concerned the payment of public sector salaries. The court cited a lack of jurisdiction as the reason for its decision.

According to the court’s published schedule, as posted on its official website and monitored by PUKMEDIA, rulings had been due on two lawsuits filed against the Federal Prime Minister and the Federal Minister of Finance—both in their official capacities—concerning the disbursement of salaries to employees in the Kurdistan Region.

In the first case, numbered (104/Federal/2025), the plaintiffs requested the court to compel the Federal Ministry of Finance to continue paying the salaries of Kurdistan Region employees on a regular monthly basis and designated dates, regardless of political or administrative disputes between Baghdad and Erbil. They also sought a binding order for the Ministry to resume salary payments to public servants, retirees, the families of martyrs, and social welfare beneficiaries in the Region starting this month, until a final ruling is issued.

The second lawsuit, numbered (107/Federal/2025), submitted by two different plaintiffs, sought a ruling that would separate the issue of employee salaries in the Kurdistan Region from political disputes and ensure funding is allocated as actual expenditure.

The third case, numbered (105/Federal/2025), was brought against the President and Prime Minister of the Kurdistan Region, both in their official capacities. The plaintiff sought to overturn Decision No. (280) issued by the Kurdistan Regional Government’s Council of Ministers on 14 May 2025. The decision relates to the implementation of the 24-hour electricity supply initiative (the “Runaki Project”), which includes allocating 265 billion dinars annually to support increased electricity access for subscribers.

The Federal Supreme Court ultimately dismissed all three cases on the grounds of a lack of jurisdiction.
