Lahur Jangi Burhan Case to Remain in Sulaymaniyah, Court Confirms

A judicial source has confirmed that the case file of the defendant, Lahur Jangi Burhan, will remain in Sulaymaniyah and will not be transferred to Erbil. The source added that Lahur Jangi and his co-defendants will continue to be held in Sulaymaniyah, with their files sent to the Court of Cassation in Erbil only for review purposes.
Under Iraqi law, when a crime occurs within a particular region, the defendant is tried in the courts of that region, taking into account the specific circumstances where the offence occurred.
The source explained that following the defendants’ appearance in court on charges under Article 56 of the Iraqi Penal Code, concerning criminal conspiracy, the lawyers of Lahur Jangi Burhan and his associates requested the Court of Cassation in Erbil to review the case file. The Sulaymaniyah Criminal Court subsequently forwarded the file to Erbil solely to review decisions made during the investigation phase, stressing that this is a standard legal procedure applied to all cases and not intended for issuing rulings or conducting further investigation.
The judicial source also noted that Lahur Jangi Burhan and his co-defendants face a separate case before the Sulaymaniyah Investigation Court under Article 406 of the Iraqi Penal Code, relating to premeditated murder.
