Iraq's Federal Supreme Court Ratifies Final Results of 2025 Parliamentary Elections

Iraq's Federal Supreme Court ratified the final results of the sixth term of the Iraqi parliamentary elections on Sunday, 14 December 2025. The ruling is final and binding on all authorities, in accordance with the Iraqi Constitution and applicable laws.

In a statement, the Court’s Media office confirmed that the Court held a closed session attended by its President, Judge Munther Ibrahim Hussein, along with all its members. During the session, the Court reviewed the final results submitted by the Independent High Electoral Commission (IHEC) and unanimously approved them.

A Final and Binding Constitutional Decision

The statement noted that “the decision was issued unanimously and is final and binding on all authorities, based on Articles 93 (Seventh) and 94 of the 2005 Constitution of the Republic of Iraq, as well as Articles 4 (Seventh) and 5 (Second) of the Federal Supreme Court Law No. 30 of 2005, as amended by Law No. 25 of 2021.”

Next Constitutional Steps

With the final results now ratified, the Iraqi Constitution outlines the procedures for convening the first session of the new parliament.

Article 54 stipulates that the President of the Republic must call the parliament to convene within no more than fifteen days of ratification. The session is to be chaired by the oldest member, during which the Speaker and the two Deputy Speakers must be elected. This session may not be extended beyond the constitutional deadline.

Article 55 further stipulates that the Speaker and the two Deputy Speakers shall be elected in the first session by an absolute majority of the Council’s members, through a direct secret ballot.

Membership Conditions and Validity of Representation

Article 49(6) of the Constitution affirms that membership in the parliament is incompatible with holding any other official position or employment.

Regarding challenges to membership, Article 52(1) states that the parliament must decide on the validity of its members’ representation within thirty days of an objection being filed, by a two-thirds majority.

Under Article 52(2), the Council’s decision may be appealed before the Federal Supreme Court within thirty days of its issuance.

Parliamentary Term and Legislative Powers

Article 56 establishes that the parliamentary term is four calendar years, beginning from the date of the first session. Elections for the next parliament must be held no later than forty-five days before the end of the existing term.

The powers of the parliament, outlined in Article 61, include enacting federal laws, overseeing the executive authority, electing the President of the Republic, ratifying international treaties and agreements, approving senior appointments, questioning or impeaching the President of the Republic in accordance with constitutional procedures, and approving declarations of war and states of emergency.

Article 62 requires the Council of Ministers to submit the draft federal budget and final accounts to the Council of Representatives for approval.

The parliamentary elections were held on 11 November 2025, with 20,263,773 eligible voters across 8,703 polling centres and 39,258 polling stations nationwide.

With the ratification of the results, Iraq now enters a new phase in the political process, focused on fulfilling constitutional requirements, convening the new parliament, electing key leadership positions, and forming the next government.
