Federal Supreme Court Annulls Provisions of the Regional Shura Council Law

Following a complaint from a member of the Patriotic Union of Kurdistan (PUK) in the Iraqi parliament, the Federal Supreme Court has annulled three articles along with the first amendment to the law of the Regional Shura Council. One of the annulled provisions pertains to the revocation of the authority to grant citizenship from the Administrative Court of the Kurdistan Region.

According to a statement released on the Federal Court's website: "On 22nd October 2024, the court, based on a complaint from Dr. Bryar Rashid, a member of the Iraqi parliament representing the PUK faction, has withdrawn the authority to grant citizenship from the Administrative Court of the Kurdistan Region."

According to the Federal Court's decision, Article 13, paragraph 4, which assigns the responsibility for citizenship applications to the Administrative Judicial Court, has been repealed. The court also declared the first and second paragraphs of Article 16 of the Kurdistan Regional Shura Council Law unconstitutional, stating that the Administrative Judicial Court is not competent to hear appeals related to administrative decisions or matters concerning the powers of the President of the Kurdistan Region.

According to the statement, the Federal Court ruled that the first amendment to the Kurdistan Regional Shura Council Law No. 17 of 2022, which was approved by the Kurdistan Parliament in 2022, is unconstitutional.
